PET POLICY FOR 900 MARSHY COVE CONDOMINIUM ASSOCIATION, INC.
I. Pet Policy Provisions
LET IT BE RESOLVED THAT in order to ensure that the rights of owners to keep pets and the rights of other owners will be respected, the 900 Marshy Cove Condo Association Board of Directors establishes the following Pet Policy (Note - The Federal Fair Housing Act requires associations to exempt service animals from pet policies and rules):
1. All present and future pet owners must complete a PET APPLICATION AND REGISTRATION FORM (attached) and pay a $50/per year pet registration fee for each pet before occupying the condominium. The Condominium Association management company, a board member, or their agent, will present a copy of the Pet Policy to the resident for review and signature.
For pet previously registered, the renewal fee is $25.  After March 31, a late fee of $100 will automatically be assessed to the unit owner’s account.
2. Unit owners are limited to two (2) pets (dog(s) and/or cat(s). Other domesticated pets may be allowed with specific approval of the Condo Association. All dogs and cats must be spayed or neutered. Dogs or cats may not exceed 55 pounds fully grown.
3. All pets will be registered with the condominium management company. Registration requirements include the owner’s home and office telephone numbers, a photo of the pet·
(optional), a current rabies vaccination certificate, and other records of inoculations as designated by the County. (see Pet Application and Registration Form attached).
4. No pets will be kept or bred for commercial purposes within the Condominium.
5. Pets will always be attended and leashed at all times in all common areas, including entrances, lobby, elevators, garage, etc., as well as in owner's limited common areas, such as decks. Pets will not be leashed to common areas or limited common areas, such as decks, or to any stationary objects in the common areas such as stakes or similar objects placed in the ground, or to a tree or building.
6. No dogs are allowed to run free outside of the unit owner's residence. No dog runs, cages, or dog houses are allowed on the common areas. Dog houses and cat litter boxes are not permitted in hallways or decks.
7. No pets are allowed in the pool complex, pool area, or in any future recreation area.
8. Pet owners will tag all dogs and cats showing at a minimum the owner's name and telephone number (note: tags are necessary even if the pet has a microchip implant).
9. When walking a dog, the pet's owners will promptly remove all of pet's excrement or solid waste deposited on any portion of the property. Such waste will be bagged, tied, and placed in a trash receptacle. (Note: Dog Waste Dispenser/Disposal units are available in the common areas) Only fecal matter may be flushed down toilets; cat litter or similar materials may not be flushed down toilets but should be disposed of in plastic bags and placed in the trash; tropical bird litter should also be disposed in plastic bags and placed in the trash.
10. No pet shall be allowed to become a nuisance or create any unreasonable disturbance. Examples of nuisance-type behavior for the purposes of this paragraph are:
a. Personal injury or property damage caused by unruly behavior
b. Pets who make noise continuously and/or incessantly for a period of 10 minutes or intermittently for one-half an hour or more, disturbing any person at any time of day or night.
c. Pets in common areas that are not under complete control of a responsible human companion and on a short hand-held leash or in a pet carrier.
d. Pets that relieve themselves on walls or floors of common areas.
e. Pets that relieve themselves on common exterior elements, such as sidewalks and flower beds.
f. Pets that exhibit aggressive or vicious behavior.
g. Pets that are conspicuously unclean or parasite-infected.
11. All damage caused by a pet is the sole and full responsibility of the pet owner, or the property owner if the pet owner is a renter. This includes any damage caused by cleaning chemicals or other such materials used in an attempt to remedy said damage. Any damage to association property will be repaired by the association and billed to the property owner. Pet owners are also responsible for any damage, injury, or disturbances their pet(s) may cause or inflict.
12. Owners and tenants are responsible for visiting pets, who are subject to the restrictions as resident pets. Visiting pets must be leashed.
13. Pet owners shall indemnify the Association and hold it harmless against loss or liability of any kind arising from their pet(s) or visiting pet(s).
14. All pets will be registered and inoculated as required by local law. County rabies and/or registration tag should be attached to a collar or harness worn by the animal.
15. Control of Pets
a. Pet owners will be responsible for limiting uncontrolled barking or other pet noises between the hours of 9pm and 9am, and for limiting noise of sufficient volume to interfere with other residents' rest or peaceful enjoyment of the property before or after these hours. Pets are not permitted to cause unsanitary, dangerous or offensive conditions, to molest, attack, or otherwise interfere with the freedom of movement of persons on the common areas, to chase vehicles, to attack other pets, or to create a disturbance in any other way. Pet owners considered in violation of the excessive noise policy may be subject to fines or other sanctions.
b. If a pet has an accident in a common area, the pet owner must clean it up immediately and report it to Sentry Management. The pet owner is responsible for any damages caused by such an event.
c. Owners of animals found to be in violation of these rules or in some way disturbing or annoying other residents (for example, excessive barking, attacking residents, and accidents in common areas) will initially be warned by the Board or its management company.
Continued infractions will result in penalties of $25 for each infraction. If the violations continue, the Board reserves the right to force removal of the pet(s).
16.. Any dog trained as an attack dog is not allowed on the property. Any dog of this type found on the property is subject to immediate removal and detainment.  In addition, exotic pets, such as snakes, are not allowed under any circumstances. Unusual house pets should be specifically prohibited in this policy.  Unusual house pets include, but are not limited to animals not generally maintained as pets, such as large reptiles (lizards and snakes), felines other than cats, canines other than dogs, anthropoids (gorilla, chimpanzee, orangutan), rodents, and mammals, birds and other creatures other than those listed in the policy.
17. Property owners or residents and their guests should not feed pets other than their own (such as stray cats or pets owned by others) unless permission has been obtained from the owner. Suspected stray animals should be reported to local animal control for possible identification prior to contacting the Condo Association.
18. Property owners or residents should not abandon an unwanted pet on the property. No resident shall engage in any act of cruelty toward any animal. All acts of cruelty must be reported to the local animal control in accordance with the law.
19. Owners are responsible for appropriate and sanitary disposal of deceased pets in accordance with state and local laws and ordinances

II. Enforcement of Violations
Recognizing that accidental infractions are bound to occur, it is not the intention of these rules to be unduly restrictive. However, the following rules regarding notification and enforcement procedures are intended to apply to rule violations by pet owners.
1. Any owner, resident, or managing agent observing an infraction of any of the Condo
Pet Policy shall discuss the infraction in a neighborly fashion with the pet owner in an effort to secure voluntary compliance.
2. If the complaint is not satisfied voluntarily by the pet owner, the complaint must be put in writing, signed by the complainant and presented to the Condo board of directors or its managing agent. If the board is in agreement with such complaint, the pet owner will receive written notice of the violation.
3. If after three (3) violations the problem is still unresolved, arrangements will be made for a hearing according to Article 11-113 of the Maryland Condominium Act.
4. If a unit owner fails to comply, the board of directors may require the permanent removal of any pet. If so determined, the pet owner will have 30 days to remove the pet from the premises. The board of directors also has the authority to assess and collect fines for violations of the house rules pertaining to pets and to assess and collect amounts necessary to repair or replace damaged areas or objects.

1. Both parties have read, agreed to, and signed the attached Pet Policy in effect for the 900 Marshy Cove Condominium.
2. The unit owner or tenant will keep his/her pet in a responsible manner and provide proper care for the pet as detailed in the 900 Marshy Cove Condominium Pet Policy.
3. The unit owner or tenant agrees to pay a non-refundable registration fee of $50 per pet per year to cover the costs associated with cleaning and repairs of damage, both interior and exterior, caused by pets. Renewal fee, $25 per pet per year. Failure to register your pet(s) before April 1, will result in a fine of $100 charged directly to the unit owner’s account.
4. The unit owner or tenant will provide management with certification that the pet(s) is/are vaccinated in accordance with state and local ordinances.

6. It is the pet owner's responsibility to update the information listed in items 4 and 5 above. If the unit owner is unable to provide the name of a pet caretaker, he/she will provide details of other arrangements made for the proper care of the pet.
7. Unit owners or tenants may be fined for non-compliance with the 900 Marshy Cove Condominium Pet Policy.
